Editor’s note: Each month, the legal office publishes the results of actions under the Uniform Code of Military Justice completed during the previous month. Specific individuals who received Nonjudicial Punishment are not identified.
Article 15 Actions:
During February 2012, D-M commanders administered 5 Nonjudicial Punishment actions under Article 15 of the UCMJ. The punishments imposed reflect the commander’s determination of an appropriate punishment after considering the circumstances of the offense and the offender’s record. A “suspended” punishment does not take effect unless the offender engages in additional misconduct or fails to satisfy the conditions of the suspension. The suspension period usually lasts for six months unless a lesser amount is specified.
Failure to Obey- An Airman First Class received reduction to the grade of Airman Basic, suspended forfeiture of $745.00 pay per month for 2 months, restriction for 20 days, 20 days extra duty and a reprimand.
Failure to Obey- An Airman First Class received reduction to the grade of Airman Basic and a reprimand.
False statement- A Senior Airman received reduction to the grade of Airman First Class, suspended forfeiture of $990.00 pay per month for 2 months and 14 days extra duty.
AWOL – An Airman First Class received reduction to the grade of Airman and 31 days extra duty.
AWOL- An Airman First Class received suspended reduction to the grade of Airman and 15 days extra duty.
Administrative Discharges:
During the month of February 2012, D-M commanders completed 11 administrative discharge actions. Of those 11 actions, 2 were for DUI related misconduct, 2 were for fitness failure, 3 were for misconduct, and 4 were for other reasons. Probation and Rehabilitation (P&R) is a 6 to 12 month conditional suspension of the administrative discharge, similar to a probationary period. Under P&R, execution of the approved discharge is conditionally suspended to give the member a chance to prove that he or she is able to meet Air Force standards. Although P&R is an option for commanders in recommending administrative discharge, no members received P&R for any of the February administrative discharge actions.

Airman First Class Allen Ehmes, 755th Aircraft Maintenance Squadron, was tried by special court-martial Feb. 23. He pled guilty to one charge of drunk driving in violation of Article 111. He was sentenced by a judge to a reduction to the grade of E-2, forfeiture of $500 pay per month for two months, confinement for 40 days and restriction for 30 days, and 30 days of hard labor without confinement.
Airman Christopher J. Martin, 355th Security Forces Squadron, was tried by special court-martial Jan. 31 – Feb. 1. He pled guilty to one charge of failing to obey a lawful order, in violation of Article 92; one charge of willfully disobeying superior commissioned officer, in violation of Article 90; and two charges of drunk driving, in violation of Article 111. He was sentenced by members to a reduction to E-1 and a Bad Conduct Discharge.
Airman First Class Tyler J. Mohr, 355th Equipment Maintenance Squadron, was tried by special court-martial on Feb. 9. He pled guilty to one charge of wrongful possession and distribution of Ecstasy, in violation of Article 112a. He was sentenced by a judge to a reduction to the grade of E-1, forfeiture of $900 pay per month for three months, restriction for 60 days, hard labor without confinement for 60 days and confinement for 35 days.
