Crime and Punishment: June – August 2012

Article 15 Actions – August

During August 2012, D-M commanders administered 11 Nonjudicial Punishment actions under Article 15 of the UCMJ. The punishments imposed reflect the commander’s determination of an appropriate punishment after considering the circumstances of the offense and the offender’s record. A “suspended” punishment does not take effect unless the offender engages in additional misconduct or fails to satisfy the conditions of the suspension. The suspension period usually lasts for six months unless a lesser amount is specified.

-Failure to Obey – A Senior Airman received a suspended reduction to the grade of Airman, reduction to the grade of Airman First Class, a suspended forfeiture of $835.00 pay for two months, 21days extra duty and a reprimand.

-Wrongful Use of a Controlled Substance (Marijuana) – An Airman First Class received a reduction to the grade of Airman Basic and 45 days extra duty.

-Failure to Obey – An Airman First Class received a suspended reduction to the grade of Airman Basic, reduction to the grade of Airman, 15 days extra duty, 15 days restriction, and a reprimand.

-Failure to Obey – An Airman received a received a reduction to the grade of Airman Basic, 15 days extra duty, 15 days restriction, and a reprimand.

-False Official Statement and Dereliction of Duty – A Technical Sergeant received a suspended reduction to the grade of Staff Sergeant, forfeiture of $1506.00 pay for two months, 30 days extra duty, and a reprimand.

-Failure to Go, False Official Statement and Dereliction of Duty – A Senior Airman received a reduction to the grade of Airman First Class, 14 days extra duty, and a reprimand.

-Failure to Go, Failure to Pay Just Debts – An Airman First Class received a suspended reduction to the grade of Airman, a suspended forfeiture of $835.00 pay for two months, 30 days restriction, 30 days extra duty, and a reprimand.

-Sleeping on Post – An Airman First Class received a suspended reduction to the grade of Airman, a suspended forfeiture of $250.00 pay for two months, and 15 days extra duty.

-False Official Statement and Dereliction of Duty – An Airman Basic received a forfeiture of $500.00 pay for two months, 30 days restriction, and 30 days extra duty.

-False Official Statement and Dereliction of Duty – A Senior Airman received a suspended reduction to the grade of Airman First Class and 15 days extra duty.

-Failure to Pay Just Debts – A Senior Airman received a suspended reduction to the grade of Airman, reduction to the grade of Airman First Class and a suspended forfeiture of $990.00 pay for two months.

-Willful Dereliction – An Airman First Class received a suspended reduction to the grade of Airman, forfeitures of $225.00 pay per month for two months and 21 days extra duty.

-Willful Dereliction – A Staff Sergeant received a suspended reduction to the grade of Senior Airman and 15 days extra duty.

-Failure to Obey – A Senior Airman received a reduction to the grade of Airman First Class, 20 days extra duty, and a reprimand.

-Failure to Obey – An Airman received a reduction to the grade of Airman Basic, restriction for 30 days, and a reprimand.

-Larceny and Wrongful Appropriation – An Airman First Class received a received a suspended reduction to the grade of Airman Basic, reduction to the grade of Airman, forfeiture of $59.00 pay, and 14 days extra duty.

-Misbehavior of Sentinel or Lookout – An Airman First Class received a reduction to the grade of Airman, five days extra duty, and a reprimand.

-Failure to Obey – A Senior Airman received 20 days extra duty, and a reprimand.

-Willful Dereliction – An Airman received a reduction to the grade of Airman Basic and a reprimand.

-Failure to Go – An Airman First Class received a suspended reduction to the grade of Airman, 30 days restriction,  and 30 days extra duty.

 

Administrative Discharges – July

During the month of July 2012, D-M commanders completed nine administrative discharge actions. Of the nine actions, six were notification discharges, two were board hearing waivers, and one discharge went to a board hearing. Five of the discharges were for PT failure, including both board waivers and the board hearing. At the board hearing, the board panel recommended discharge without probation and rehabilitation.  The remaining four discharges included one discharge for minor disciplinary infractions and three for conditions that interfere with military service – two of which were alcohol related.

A “suspended” punishment does not take effect unless the offender engages in additional misconduct or fails to satisfy the conditions of the suspension. The suspension period usually lasts for six months unless a lesser amount is specified.

 

-Willful Dereliction – An Airman First Class received a suspended reduction to the grade of Airman and 21 days extra duty.

-Spice and Marijuana Use – An Airman received a reduction to the grade of Airman Basic, 30 days extra duty, and a reprimand.

-Marijuana Use – A Senior Airman received a reduction to the grade of Airman First Class, forfeiture of $355.00 pay, 30 days extra duty and a reprimand.

-Spice and Marijuana Use – An Airman received a reduction to the grade of Airman Basic and 30 days extra duty, and a reprimand.

-False Official Statement and Drunk Driving – A Senior Airman received a suspended reduction to the grade of Airman, reduction to the grade of Airman First Class, forfeiture of $934.00 pay per month for two months, 45 days extra duty, and a reprimand.

-Failure to Obey – An Airman First Class received a reduction to the grade of Airman, 14 days extra duty, and a reprimand.

-Adultery – A Staff Sergeant received a suspended reduction to the grade of Senior Airman,  21 days extra duty,  and a reprimand.

-Failure to Obey (x3) and False Official Statement – An Airman First Class received a reduction to the grade of Airman Basic and 21 days extra duty.

-Failure to Obey, Altering Gov. ID, and Signing False Official Statement – An Airman First Class received a reduction to the grade of Airman and 30 days extra duty.

-Assault – A Senior Airman received a reduction to the grade of Airman First Class, and a reprimand.

-False Official Statement and Wrongful Use Of Prescription Drugs – An Airman First Class received a reduction to the grade of Airman forfeiture of $400.00 pay per month for two months, restriction for 21 days, and 21 days extra duty.

-Marijuana Use – A Senior Airman received a reduction to the grade of Airman, 15 days extra duty and a reprimand.

-Failure to Obey – An Airman First Class received a suspended reduction to the grade of Airman, restriction for 13 days and nine days extra duty.

-Failure to Obey – An Airman First Class received a suspended reduction to the grade of Airman, restriction for 13 days and nine days extra duty.

-Failure to Obey – An Airman First Class received a suspended reduction to the grade of Airman, restriction for 13 days and nine days extra duty.

-Dereliction – A Staff Sergeant received a suspended reduction to the grade of Senior Airman, forfeitures of $400.00 pay per month for two months.
