October 2012 Crime and Punishment

ARTICLE 15 ACTIONS:
During October 2012, D-M commanders administered eight Nonjudicial Punishment actions under Article 15 of the UCMJ. The punishments imposed reflect the commander’s determination of an appropriate punishment after considering the circumstances of the offense and the offender’s record. A “suspended” punishment does not take effect unless the offender engages in additional misconduct or fails to satisfy the conditions of the suspension. The suspension period usually lasts for six months unless a lesser amount is specified.

AWOL – A Staff Sergeant received a suspended reduction to the grade of Senior Airman, forfeitures of $250 pay per month for two months, 30 days of extra duty and a reprimand.

Failure to Obey (GTC Misuse) – A Senior Airman received a reduction to the rank of Airman First Class, 45 days extra duty, and a reprimand.

Dereliction of Duty and Drunk on duty – A Staff Sergeant received a reduction to the grade of Senior Airman, 21 days extra duty and a reprimand.

Dereliction of Duty – A Senior Airman received a suspended reduction to the grade of Airman First Class, forfeitures of $400 pay per month for two months, 30 days extra duty and a reprimand.

Dereliction of Duty – A Staff Sergeant received a suspended reduction to the grade of Senior Airman, forfeitures of $800 pay per month for two months, 45 days of extra duty, and a reprimand.

Reckless Endangerment – An Airman First Class received 15 days extra duty and a reprimand.

Failure to Obey and Drunk on Duty – A Senior Airman received a suspended reduction to the grade of Airman First Class and 30 days extra duty.

Dereliction of Duty – An Airman First Class received a suspended reduction to the rank of Airman.

DM 90% Compliant
The Air Force metric is to process 80% of all Article 15s within 30 calendar days.

Q: Can an Article 15 result in a federal conviction?

A: No. While some of the punishments administered in an Article 15 are similar to those that can be adjudged at a court-martial, like forfeitures and reduction in rank, an Article 15 cannot result in a federal conviction. This is because of its forum. An Article 15 is “nonjudicial” punishment and therefore cannot result in a conviction.
