February 2013 Crime and Punishment

Each month, the legal office publishes the results of actions under the Uniform Code of Military Justice completed during the previous month. Specific individuals who received Nonjudicial Punishment are not identified.

Article 15 Actions

During February 2013, D-M commanders administered seven Nonjudicial Punishment actions under Article 15 of the UCMJ. The punishments imposed reflect the commander’s determination of an appropriate punishment after considering the circumstances of the offense and the offender’s record. A “suspended” punishment does not take effect unless the offender engages in additional misconduct or fails to satisfy the conditions of the suspension. The suspension period usually lasts for six months unless a lesser amount is specified.

Dereliction of Duty – A senior airman received a reduction to the grade of airman first class, suspended forfeitures of $849 pay per month for one month, and 30 days extra duty.

Failure to Obey – An airman first class received a suspended reduction to the grade of airman, 10 days extra duty, and a reprimand.

Larceny – An airman first class received a suspended reduction to the grade of airman, forfeitures of $30 pay per month for one month, and 14 days extra duty.

Failure to Obey – A senior airman received a reduction to the grade of airman and a reprimand.

Damage to Military Property and Dereliction of Duty – A technical sergeant received suspended forfeitures of $1,777 pay per month for two months and a reprimand.

Dereliction of Duty – An airman first class received a reduction to the grade of airman basic, suspended restriction to Davis-Monthan Air Force Base for 45 days, and 45 days extra duty.

Airman Trent A. Rose, 355th Logistics Readiness Squadron, was tried by special court-martial on 21 February 2013. He was charged with drunk driving. Rose plead guilty to the charge and was sentenced to be reduced to the grade of airman basic, to be restricted to the limits of D-M for 45 days, to perform hard labor without confinement for 45 days, and to be confined for 15 days.
