Justice Report – October 12, 2012

The following is a report of justice and administrative actions for September:

Courts-Martial

A technical sergeant was found guilty of two specifications of Article 80, attempting to steal military property of a value of less than $500, two specifications of Article 112a, wrongful possession of a controlled substance (oxycodone), and two specifications of Article 121, theft of military property of a value less than $500. The member received a sentence of confinement for six months, reduction to E-4 and forfeiture of $1,000 pay per month for six months.

56th Mission Support Group

Articles 15

A senior airman received an Article 15 for assault and drunk and disorderly conduct. The member received a reduction to E-3 and a reprimand.

A senior airman received an Article 15 for violation of a lawful order. The member received a suspended reduction to E-3, seven days extra duty and a reprimand.

An airman first class received an Article 15 for dereliction of duty and failure to go. The member received a reduction to E-2 and a reprimand.

56th Maintenance Group

Articles 15

A senior airman received an Article 15 for adultery. The member received a reduction to E-3, forfeiture of $990 pay and a reprimand.

Demotions

An Airman first class was administratively demoted for a DUI.

56th Operations Group

Articles 15

A senior airman received an Article 15 for being drunk to the slightest degree in violation of Arizona Revised Statutes. The member received a suspended reduction to E-3, forfeiture of $934 pay per month for two months, with the amount in excess of $300 pay per month for two months suspended, 30 days restriction to Luke Air Force Base and a reprimand.

Article 15 punishments for similar offenses may vary from case to case based on the circumstances of the offense and such factors as an offender’s age, military and disciplinary record, financial condition, and suitability for continued service. Administrative demotions are based on the member’s entire military record and ability to overcome their deficiencies. To ensure fair administration of justice throughout the Luke community, the legal office reviews all cases.
