Justice Report

56th Fighter Wing Legal Office

The following is a list of justice and administrative actions for December 2012:

56th Maintenance Group

Courts-martial
An airman was found guilty of two specifications of Article 92, failure to obey a lawful order, wrongful use and possession of spice. The member received a sentence of confinement for 19 days, reduction to E-1 and forfeiture of $497 pay.

A senior airman was found guilty of two specifications of Article 112a, wrongful use of a controlled substance. The member was sentenced to confinement for six months, reduction to E-1 and forfeiture of $497.00 pay.

Articles 15
An airman first class received an Article 15 for a false official statement and wrongful use of a controlled substance. The member received a suspended reduction to E-1, 30 days extra duty, 30 days restriction to base and a reprimand.

A staff sergeant received an Article 15 for assault consummated by a battery. The member received a reduction to E-4, suspended forfeiture of $500 pay per month for two months and a reprimand.

A technical sergeant received an Article 15 for damaging military property valued at more than $500. The member received forfeiture of $1,000 pay per month for two months, 15 days extra duty and a reprimand.

Demotions
An airman first class was administratively demoted for failure to fulfill responsibilities and drug use.

56th Mission Support Group

Courts-martial
An airman first class was found guilty of three specifications of Article 112a, wrongful use, possession and distribution of a controlled substance. The member received a sentence of a bad conduct discharge, three months confinement, reduction to E-1 and forfeiture of $990 pay per month for three months.

A staff sergeant was found guilty of a specification of Article 80, attempted wrongful sexual contact. The member received a sentence of confinement for four months and reduction to E-1.

Articles 15
An airman received an Article 15 for failure to go. The member received a reduction to E-1 and a reprimand.

An airman first class received an Article 15 for dereliction of duty and for giving a military identification card to an unauthorized civilian. The member received a reduction to E-1.

Article 15 punishments for similar offenses may vary from case to case based on the circumstances of the offense and such factors as an offender’s age, military and disciplinary record, financial condition and suitability for continued service. Administrative demotions are based on the member’s entire military record and ability to overcome their deficiencies. To ensure fair administration of justice throughout the Luke community, the legal office reviews all cases.
