Justice Report – March 22, 2013

The following is a list of justice and administrative actions in February:

56th Fighter Wing Courts-Martial

A senior airman was found guilty of a specification of Article 111, drunken operation of a vehicle and a specification of Article 112a, wrongful use of marijuana. The member received a reduction to E-1, forfeiture of $994 pay per month for six months and three months confinement.

Article 15s

An airman first class received an Article 15 for drunk driving and being incapacitated for the performance of duties. The member received a reduction to E-2, with a suspended reduction to E-1, forfeiture of $758 pay per month for two months, 30 days restriction to base and a reprimand.

56th Maintenance Group

Courts-Martial

A staff sergeant was found guilty of a specification of Article 112a, wrongful use of cocaine. The member received a reduction to E-1, forfeiture of $250 pay per month for five months and 70 days confinement.

Articles 15

A technical sergeant received an Article 15 for dereliction of duty, technical order violation. The member received a reduction to E-5, suspended forfeitures of $1,522 pay per month for two months and a reprimand.

A senior airman received an Article 15 for dereliction of duty, technical order violation. The member received a suspended reduction to E-3, forfeiture of $500 pay per month for two months and a reprimand.

A senior airman received an Article 15 for being absent without leave. The member received a reduction to E-3, forfeiture of $500 pay per month for two months and a reprimand.

A senior airman received an Article 15 for wrongful use of a controlled substance, marijuana. The member received a reduction to E-3 with a suspended reduction to E-2 and a reprimand.

Article 15 punishments for similar offenses may vary from case to case based on the circumstances of the offense and such factors as an offender’s age, military and disciplinary record, financial condition and suitability for continued service. To ensure fair administration of justice throughout the Luke community, the legal office reviews all cases.
