Justice Report

The following is a list of justice and administrative actions issued at Luke Air Force Base in the third quarter:

56th Maintenance Group

Courts-martial

• An airman first class was found guilty of underage drinking, drunk driving and making a false official statement. The member received forfeiture of $1,266 pay per month for three months, hard labor without confinement for two months and restriction to base for two months.

• A senior airman was found guilty of indecent acts, indecent language, rape using force, abusive sexual contact, sexual abuse of a child and failure to obey. The member received a reduction to E-1, forfeiture of all pay and allowances, confinement for six years and a dishonorable discharge.

• A staff sergeant was found guilty of assault and disorderly conduct. The member received a reduction to E-3, forfeiture of $1,343 pay per month for two months, restriction to base for two months and hard labor without confinement for two months.

Articles 15

• An airman first class received an Article 15 for dereliction of duty. The member received a suspended reduction to E-3, forfeiture of $200 pay per month for two months and a reprimand.

• An airman first class received an Article 15 for dereliction of duty, drunk driving and wrongful use of a controlled substance. The member received a reduction to E-2, forfeiture of $849 pay per month for two months and a reprimand.

• An airman first class received an Article 15 for underage drinking. The member received a suspended reduction to E-2, forfeiture of $250 pay per month for two months and a reprimand.

• An airman first class received an Article 15 for wrongful appropriation. The member received a suspended reduction to E-2, forfeiture of $125 pay per month for two months and a reprimand.

• A senior airman received an Article 15 for assault, damaging military property, disorderly conduct and communicating a threat. The member received a reduction to E-2, 60 days restriction, 14 days extra duty and a reprimand.

• A senior airman received an Article 15 for failing to pay debts and dereliction of duty. The member received a reduction to E-3, suspended forfeiture of $250 pay per month for two months.

• A senior airman received an Article 15 for failure to go and making a false official statement. The member received a suspended reduction to E-3 and a reprimand.

• A senior airman received an Article 15 for dereliction of duty. The member received a suspended a reduction to E-3, forfeiture of $500 pay, 10 days extra duty and a reprimand.

• A senior airman received an Article 15 for absence without leave. The member received a suspended reduction to E-3, forfeiture of $635 pay per month for two months, restriction to base for 14 days and a reprimand.

• A staff sergeant received an Article 15 for dereliction of duty. The member received a suspended reduction to E-4, 30 days extra duty and a reprimand.

• A technical sergeant received an Article 15 for drunk driving. The member received a suspended reduction to E-5, forfeiture of $1,532 pay, 30 days extra duty and a reprimand.

• A technical sergeant received an Article 15 for cruelty and maltreatment, disorderly conduct and indecent exposure. The member received a reduction to E-5, forfeiture of $1,532 pay per month for two months, 45 days extra duty and a reprimand.

• A technical sergeant received an Article 15 for unprofessional relationships. The member received a suspended reduction to E-5, forfeiture of $1,532 pay per month for two months and a reprimand.

• A technical sergeant received an Article 15 for drunk driving. The member received a reduction to E-5 and a reprimand.

Demotions

• A senior airman was administratively demoted for DUI.

• A staff sergeant was administratively demoted for physical training failure.

• A staff sergeant was administratively demoted for PT failure.

• A master sergeant was administratively demoted for PT failure.

56th Mission Support Group

Courts-martial

• An airman first class was found guilty of drunk driving and wrongful use of controlled substances. The member received a reduction to E-1, forfeiture of $1,000 pay per month for four months and 100 days confinement.

• A staff sergeant was found guilty of wrongful possession and use of a controlled substance. The member received a reduction to E-4, forfeiture of $1,000 pay per month for three months and 90 days confinement.

• An airman first class was found guilty of wrongful use of a controlled substance. The member received a reduction to E-1, forfeiture of $1,010 pay and restriction to base for two months.

Articles 15

• An airman first class received an Article 15 for wrongful appropriation. The member received a suspended reduction to E-2, forfeiture of $499 pay, 30 days extra duty and a reprimand.

• A senior airman received an Article 15 for wrongful use of a controlled substance. The member received a reduction to E-3, suspended forfeiture of $1,007 pay per month for two months, 14 days extra duty and a reprimand.

• A technical sergeant received an Article 15 for dereliction of duty, disorderly conduct and assault. The member received a reduction to E-5, forfeiture of $220 pay and a reprimand.

56th Operations Group

Articles 15

• An airman first class received an Article 15 for dereliction of duty and making a false official statement. The member received a suspended reduction to E-2, forfeiture of $849 pay per month for two months, 30 days restriction and a reprimand.

• An airman first class received an Article 15 for drunk driving and drunkenness/incapacitation for the performance of duties. The member received a reduction to E-2, forfeiture of $849 pay, suspended 45 days extra duty and a reprimand.

• A senior airman received an Article 15 for adultery, assault, dereliction of duty and failure to obey. The member received a reduction to E-3, forfeiture of $1,007 pay, 45 days extra duty and a reprimand.

Article 15 punishments for similar offenses may vary from case to case based on the circumstances of the offense and such factors as an offender’s age, military and disciplinary record, financial condition and suitability for continued service. Administrative demotions are based on the member’s entire military record and ability to overcome his deficiencies. To ensure the fair administration of justice throughout the Luke community, the legal office reviews all cases.
